    Buildcorp Group Points the Finger as Star Entertainment Group seeks $4.4 Mill for Combustible-Cladding Repairs
    Buildcorp is responding by “pointing the finger”at subcontractors: i.e., they’re seeking to shift liability or blame to downstream parties rather than accepting full responsibility themselves.
    The issue centres on cladding installed that’s now deemed combustible / non-compliant (or higher risk) and hence requiring remediation—which has cost Star the A$4.4 m figure.

    Federal Court Allows Late Opt-out in Cladding Class Action (CCA)
    The class action concerned alleged defects in cladding products supplied by 3A Composites GmbH and supplied by Halifax Vogel Group, used in various residential strata developments. Hamilton Locke’s client –- a developer and likely a group member as a result – sought to opt out of the proceedings to pursue a separate claim in the Supreme Court of New South Wales, citing contractual and factual circumstances, including the risk of different findings of facts and law in circumstances where the developer faced a claim relating for that cladding in the Supreme Court.

    ACP Decision – The Owners—Strata Plan 93105 V Richard Crookes Constructions Pty Ltd [2025] NSWSC 935
    The Plaintiff, an owners corporation, brought a claim against the Defendant builder and developer of the owners corporation’s strata scheme, for the installation of combustible Aluminium Composite Cladding on the common property.
    The decision provides useful guidance on the requirements of a gross sum costs order and a reminder to parties that they must attend a mediation in good faith or risk costs consequences.

    Developer Wins Bid to Drop Out of Cladding Class Action, One Year After Trial
    In a major recent development in the Mascot (Sydney) cladding case: Tiptell, the developer of a tower alleged to contain combustible Alucobond cladding, has won the right to opt out of a Federal Court class action against 3A Composites and Halifax. This decision allows Tiptell to pursue its own individual claim—valued at around AUD 15 million—instead of remaining a group member of the ongoing class action. Class Action Overview: The broader suit accuses 3A Composites and Halifax (Halifax Vogel Group) of supplying Alucobond cladding with a flammable polyethylene core—linked to well-known fires like Grenfell (London, 2017) and Lacrosse (Melbourne, 2014)—and allegedly making misleading safety claims during marketing.

    • Greater Control: By exiting the collective action, Tiptell gains full autonomy over how it pursues its claim—including strategy, timing, and legal arguments—rather than being constrained by class-wide decisions.
    • Potential for Higher Recovery: Tiptell’s individual claim (AUD 15 million) may exceed what it would receive as part of a class settlement.
    • Legal Precedent: This highlights how developers increasingly assert their rights post-trial, indicating a shift toward more fragmented but strategically tailored litigation in cladding disputes.

    CRAZY COINCIDENCE – Exactly 8 Years to the Day of the Grenfell Fire a Massive Cladding Fire Engulfs Dubai Tower
    The fire, which started around 11:45 PM, quickly spread through the exterior cladding of the 67-storey tower, creating a terrifying visual as flames licked the sky.
    The affected high-rise, like several others constructed before the UAE’s updated fire safety regulations, is covered in aluminium composite panel (ACP) cladding.
    Dubai has been actively replacing ACP cladding on many towers since the government enforced stricter fire codes in the wake of several previous incidents across the country. However, thousands of buildings still use older materials, making this latest fire another reminder of the need for continued inspections and safety upgrades.

    Melbourne Testing Laboratory Leading Fire Research on Dangerous Cladding
    ExcelPlas Labs have tested a variety of cladding types on buildings with a range of tests to increase the understanding of the performance of these products and the degree of risk they pose in the event of fire.  The products tested are ACP-FR70 which refers to an ACP panel comprised of approximately 70% flame retardant filler such as ATH or MDH, while ACP-NFR45 refers to a panel which has approximately 45% non-flame retardant (NFR) filler, such as calcium carbonate. For ACP-PE, the ‘PE’ denotes all types of polymers, with polyethylene being the most commonly present.  ExcelPlas research has discovered that the polymer content alone is not determinative of combustibility, but importantly the percentage and composition of the fire-retardant filler and/or other inert fillers has a significant impact on the performance of a product in a fire.  Detailed compositional analysis is KEY to assessing fire risk.  ExcelPlas Knows Polymers & Knows Testing!
