Arconic Gets Reamed with Damming Criticism in Grenfell Inquiry Report
Arconic deliberately concealed from the market the true extent of the danger of using Reynobond 55 PE in cassette form, particularly on high-rise buildings.
Arconic had been in possession of test data showing that in its cassette form the product reacted to fire in a very dangerous way and could not be classified in accordance with European standards.
Arconic was aware that there was serious concern in the construction industry about the safety of ACM panels and had itself recognised the danger they posed.
Arconic was determined to exploit what it saw as weak regulatory regimes in certain countries (including the UK) to sell Reynobond 55 PE in cassette form, including for use on residential buildings.
Arconic did not consider withdrawing Reynobond 55 PE in favour of the fire-resistant version despite the knowledge gained from cladding fires in Dubai in 2012 and 2013.
Arconic failed to inform the BBA of revised fire testing result classifications

Kingspan knowingly created a false market in insulation for use on buildings over 18 metres in height
Kingspan’s claim that K15 met the requirements for Class 0 was based on a test of the foil facer alone and was disingenuous.
Kingspan cynically exploited the industry’s lack of detailed knowledge about BS 8414 and BR 135 and relied on the fact that an unsuspecting market was very likely to rely on its own claims about the product.

Judge hears submissions by 3A’s barrister Matthew Darke SC and HVG’s barrister Nicholas Owens SC about why the firms should not be liable for compensating building owners
The companies have claimed that the fault lay with architects who did not properly assess whether the cladding could be safely installed in the buildings they were designing.
3A also denies it marketed the material or it even carried out business in Australia, because it is a German company.HVG’s barrister Nicholas Owens SC said it was strange the class action sued his client and 3A despite admitting to an industry-wide problem with building professionals who did not do their jobs
There was nothing wrong with the cladding, the issue was its misuse, he said.3A’s Barrister Matthew Darke SC said while the class action sought to blame his client, properly assessing the fire safety of newly constructed buildings lay “wholly and solely” with architects, safety engineers and certifiers
He said no one would assume 3A’s Alucobond PE or Plus cladding, which are targeted in the class action, could be used in any way or in any quantity on any type of building without ever increasing the fire danger.
“We say that consumers do not regard goods as not being of acceptable quality because they can’t be used in the way that a negligent or careless qualified professional recommends or allows them to be used,” Mr Darke said.Kingspan Settles in Cladding Compensation Test Case
