LU Simon Loses Special Case in Victoria’s Combustible Cladding Action Over Atlantis
Despite the Federal Court’s finding on insurance coverage, the Victorian Court of Appeal ruled against LU Simon on a separate issue regarding the builder’s liability. The court determined that LU Simon could not rely solely on the advice of consultants to avoid responsibility for the use of non-compliant cladding.
