    Court of Appeal – State of Victoria v LU Simon Builders Pty Ltd & Ors [2025] VSCA 52 (11 April 2025)

    LU Simon Loses Special Case in Victoria’s Combustible Cladding Action Over Atlantis
    Despite the Federal Court’s finding on insurance coverage, the Victorian Court of Appeal ruled against LU Simon on a separate issue regarding the builder’s liability. The court determined that LU Simon could not rely solely on the advice of consultants to avoid responsibility for the use of non-compliant cladding. This decision reinforces the accountability of builders for ensuring compliance with building codes, even when consultants are involved.
