Important Court Decision Concerning Vitrabond FR Cladding
NSW Court of Appeal’s judgment in Owners SP 92450 v JKN Para 1 Pty Limited [2023] NSWCA 114.
This is an important intermediate appellate court decision because the NSW Court of Appeal found that:
- the core of the Vitrabond FR was approximately 35% to 41% polyethylene;
- the Vitrabond FR did not comply with the BCA; and
- the Owners Corporation is entitled to recover the costs of removing and replacing the Vitrabond FR
